Terms of Service
These Terms of Service (the "Terms") govern your use of Plonq, a free bill-splitting app for friends. By creating an account or otherwise using Plonq, you agree to these Terms and to the Privacy Policy. If you do not agree, please do not use Plonq.
Who can use Plonq
You must be at least 13 years old to use Plonq. By creating an account, you confirm that you meet this age requirement, that the information you provide is accurate, and that you have the right to enter into these Terms.
You may have one Plonq account per person. You are responsible for keeping your sign-in credentials secure and for any activity on your account. If you become aware of unauthorised use of your account, please tell us at support@plonq.com.au.
About the service
Plonq is a personal record-keeping tool that helps friends and small groups keep track of shared expenses. Plonq does not move money, does not process payments and is not a financial institution. When you "settle up" in Plonq, you are recording that a payment took place outside the app — by bank transfer, PayID, cash, or however you and the other person arranged it.
The balances and totals shown in Plonq are an informal record based on what you and the other members of your groups enter. They are not legally binding statements of debt and Plonq does not guarantee their accuracy. Resolving any actual amounts owed is between you and the other people involved.
How you may use Plonq
You agree to use Plonq only for lawful, personal purposes. You agree not to:
- use Plonq for anything illegal, fraudulent or harmful;
- upload or send content that is abusive, threatening, defamatory, obscene, or that infringes anyone's rights;
- use Plonq to harass, dox or stalk any other user;
- impersonate another person or misrepresent your affiliation with anyone;
- access or attempt to access another user's account without permission;
- scrape, crawl or otherwise programmatically extract data from Plonq;
- interfere with or attempt to disrupt the service or any person's use of it; or
- reverse-engineer, decompile or attempt to derive source code from Plonq, except to the extent the law allows.
We may suspend or terminate accounts that breach these Terms, with or without notice.
Your content
You retain ownership of the content you put into Plonq — your group names, expenses, receipts, photos and profile details. By using Plonq you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process and display that content for the sole purpose of providing the service to you and to the people you share groups with.
You are responsible for the content you post. When you share information with friends or group members, they may keep what they have seen — we cannot remove it from them on your behalf.
Email from us
By creating an account you accept that we may send you:
- Account and security email — for example, email verification, password reset, security alerts and support replies. These messages relate directly to your account and are sent whenever needed.
- Activity notifications — about your groups and expenses. You can adjust these in the app's Settings.
- Occasional product updates — only if you opt in at signup or in Settings. Every product email contains a one-click unsubscribe link.
We do not sell your email address.
Service availability and warranty disclaimer
Plonq is provided on an "as is" and "as available" basis. We aim to keep Plonq available and working but we do not guarantee that the service will be uninterrupted, error-free, or that defects will be corrected.
To the maximum extent permitted by law, Plonq is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limits of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the Australian Consumer Law (or any other consumer protection law) that cannot lawfully be excluded.
Subject to that, and to the fullest extent permitted by law, Plonq is not liable for any indirect, incidental, special, consequential or punitive loss, including lost profits, lost data, or business interruption, arising out of or relating to your use of Plonq. Plonq is also not liable for disputes between users about money owed.
Ending your account
You can stop using Plonq at any time. You can delete your account from inside the app (Settings → Account → Delete account) or by emailing support@plonq.com.au. See the Privacy Policy for what happens to your information when you delete your account.
We may suspend or terminate your access to Plonq, with or without notice, if you breach these Terms or if we reasonably believe your use of Plonq creates a risk to other users, to us or to third parties.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. If we make a material change we will notify you before it takes effect. Continuing to use Plonq after a change takes effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of Plonq.
